Here is the scenario. Joe owns an LLC and has a tax ID. Bob wants to start up a business doing installation of satellite TV services under Joe’s business name. Bob wants to draw up some kind of contract that will state that while Joe is the “President” of the business, Bob will have the final say as far as hiring, payroll, etc. for the section of the business he will be running. We have no knowledge of business law and were wondering if such a contract can be drawn up. We’d like to incur minimal expense, meaning, we don’t want to have to hire a lawyer. Joe is fine with letting Bob take care of everything, because Joe and Bob are brothers. We just want something in writing. Thanks in advance.
I don’t think that Bob can legally start a business under Joe’s license. Bob needs to become a sole proprietor on his own. However, if Joe owns an installation of satellite TV svcs, Joe can become a member (employee) of the LLC by contacting the IRS and having him added as a member to the LLC. Then they could have an agreement then; but as for Joe running another business under Bob’s, that’s a no.
